Terms of Service

These terms are the agreement between you and Scriptx, UAB for the TraceItX service. By creating an account or using the Service you agree to them.

These Terms of Service (the “Terms”) govern your access to and use of the TraceItX website, ingest service, SDKs, and admin console (the “Service”), operated by Scriptx, UAB (“Scriptx”, “we”, “us”), a company incorporated in the Republic of Lithuania. By creating an account or otherwise using the Service, you (“you”, “Customer”) agree to these Terms. If you are agreeing on behalf of an organisation, you represent that you are authorised to bind it.

1. The Service

TraceItX is an in-app bug-reporting tool. You embed our SDKs in your applications; reports submitted by your users are validated by our ingest service, briefly stored, and forwarded as signed webhooks to the receivers you configure. TraceItX is a delivery pipe — it does not fix bugs and does not act as a system of record beyond the retention window described in our Privacy Policy.

2. Accounts

You are responsible for the security of your account credentials and SDK keys, and for all activity under your account. Notify us promptly at support@traceitx.com of any unauthorised use. You must provide accurate registration information and keep it current.

3. Plans, billing, and the event meter

  • Paid plans are billed in advance on a monthly or annual basis. Fees are stated on our pricing page and are exclusive of taxes, which we add where required.
  • The monthly event meter is a soft limit: exceeding it does not block delivery. We may notify you and ask you to upgrade; sustained overage may affect retention of over-limit events.
  • Unless stated otherwise, fees are non-refundable. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • We may change pricing for future billing periods with at least 30 days’ notice.

4. Acceptable use

You agree not to, and not to permit others to:

  • use the Service to violate any law or infringe any third party’s rights;
  • submit malware, or content you have no right to submit;
  • attempt to breach, probe, or overload the Service, or circumvent rate limits, quotas, or security controls;
  • resell or provide the Service to third parties except as your own application’s embedded reporting; or
  • use the Service to collect sensitive personal data from end users without a lawful basis and appropriate notice and consent.

5. Your data and responsibilities

You retain all rights to the data you and your users submit through the Service (“Customer Data”). You grant us a limited licence to process Customer Data solely to provide and secure the Service. You are the data controller for bug-report data and are responsible for configuring what your SDK captures, for redacting sensitive fields, and for providing any notices and obtaining any consents required from your end users. Our processing of Customer Data is further governed by our Privacy Policy and Data Processing Agreement.

6. SDK and software licence

Our client SDKs are provided under their stated open-source licences (see each SDK’s repository). Subject to those licences and these Terms, we grant you a non-exclusive, worldwide, royalty-free licence to use the SDKs to integrate the Service into your applications. The TraceItX name and logo are our trademarks and are not licensed except as needed to use the Service.

7. Service availability and changes

We work to keep the Service reliable but provide it on an “as available” basis. We may modify, suspend, or discontinue features, with reasonable notice for material changes. Enterprise availability commitments, if any, are set out in a separate order or service-level agreement.

8. Warranties and disclaimers

Except as expressly stated, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us for the Service in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnity

You will defend and indemnify Scriptx against third-party claims arising from your Customer Data or your use of the Service in breach of these Terms or applicable law.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or to comply with law or protect the Service. On termination, your right to use the Service ends and stored report artifacts are deleted in line with our retention schedule.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-laws rules. The courts of Lithuania have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the product or by email, and the “last updated” date above will change. Continued use of the Service after changes take effect constitutes acceptance.
